What is the H2B VISA PROGRAM ?
What it is. The H-2B program lets qualified U.S. employers hire foreign workers to fill temporary, non-agricultural jobs—think landscaping, hospitality, seafood processing, amusement & recreation, construction support, etc. Employers (not workers) file the petition.
Who it’s for. Employers must prove: (1) not enough U.S. workers are available; (2) hiring H-2B staff won’t harm wages/conditions of U.S. workers; and (3) the need is temporary (one-time, seasonal, peakload, or intermittent).
Annual cap. By law, there are 66,000 new H-2B visas per fiscal year—33,000 for jobs starting Oct 1–Mar 31 and 33,000 for Apr 1–Sep 30 (unused first-half numbers can move to the second half). DHS may release supplemental numbers in some years.
Stay & family. USCIS can grant H-2B status up to the period on the labor certification; extensions may reach a 3-year maximum. Spouses/children under 21 may come as H-4 (not work-authorized).
